Burning

Burning is:

  • allowed  from October 1st until April 30th each year upon issuance of burn permit, as required. Permit is only valid for the day it is issued. Starting in 2024, permits are no longer available over the phone, and will only available online.  You can click on link below to get to the website.

  • restricted, as is the rest of the state from, May 1st through September 30th each year 

This rule is set by the Georgia Environmental Protection Division (GA EPD). We are one of fifty-four counties in the state which have to follow this regulation. 

Banks County has ordinances which also regulate burning.

These can be enforced  by the County Fire Department via citation along with Code Enforcement. A violation of any provision of the County Code is punishable by a fine not to exceed $1,000.00 or imprisonment for not more than 60 days or both. Each act of violation and each day upon which any such violation shall occur shall constitute a separate offense.
